SWP3 / SWPPP Steps to Compliance

  1. Determine area to be disturbed (include all areas to be landscaped, offsite spoils or staging areas as well as any areas that are part of a common plan of development. If your site is 1 acre or more, a Storm Water Pollution Prevention Plan will need to be prepared. Large Construction Sites are 5 acres or greater and require the submission of a Notice of Intent (NOI). Small Construction Sites are between 1 and 5 acres and must have a site notice posted, but do not require an NOI permit submission or fee. Please note that homebuilders in new subdivisions must include the disturbed acreage of the entire subdivision in determining the area to be disturbed due to the "common plan of development" rule.

  2. Prepare SWPPP including site Erosion Control Map.

  3. For Large Construction Sites, obtain an active NOI permit before any site disturbance begins. NOI permits are immediately active when submitted electronically on the STEERS website. Paper copy NOI permit submissions are active 7 days from the date mailed.

  4. Post the Construction Site Notice (CSN) near the entrance of the site.

  5. Once site disturbance begins, conduct site inspections at least once every 7 days OR at least once every 14 days AND after rain events of 1/2" or more.

  6. Maintain your erosion controls and correct problems.

  7. For Large Construction Sites, terminate your permit coverage by submitting a Notice of Termination (NOT) once requirements are met.

  8. Maintain copies of all records associated with the storm water permit, SWPPP / SWP3 and inspections for at least 3 years after the NOT is filed.
